The Canyon County Clerk is the official custodian of all court records in the county, and the District Court is the court of general jurisdiction. These records also play a crucial role in the public record ecosystem and often work alongside other public records, such as arrest records.

Are Canyon County Court Records Public?

Yes. Canyon County court records are open to public inspection. Public access to court records is primarily governed by court rules rather than general state statutes, particularly Idaho Court Administrative Rule 32 (ICAR 32). This rule, established by the Idaho Supreme Court, provides that "the public has a right to examine and copy the judicial department’s declarations of law and public policy, and to examine and copy the records of all proceedings open to the public."

Some records, however, do not fall under the "open to the public" category. These records are restricted to the public and accessible only to persons with a valid interest in them. Some restricted records include

What Information is Available in Canyon County Court Records?

Canyon County Court Records Search

There are fees associated with making the request, which may also depend on the process of return.

  • In-Person Access

In-person access to court records can be done at the county courthouse. Individuals can either request the record from the County Clerk’s Office or use the iCourt Portal Kiosk to search for the record. Requesters will need to provide a name, case number, or file date to search the record. An ID may also be requested if the record sought is confidential and requires authorization to access.

  • Mail and Phone Requests

Requests for court records can also be made by completing the Court Records Request Form and mailing it to the Canyon County Clerk’s Office. Individuals may pick up the record in person or have it returned by email or mail. Opting for mail delivery may incur additional charges beyond the copy fees.

Court records in Canyon County are usually obtained for a fee if a person is not accessing them online or searching for them through the iCourt Kiosk Portal at the courthouse. The following fees apply for obtaining a copy of a record:

Criminal Records Access in Canyon County

Canyon County criminal history records can be accessed via the Idaho State Police (ISP), Bureau of Criminal Identification (BCI). Criminal history records provide a summary of a person’s interactions with the justice system, including arrests and convictions. A search for such records can be performed by name or by fingerprints, with fingerprints being the more accurate option. The fee for a fingerprint search is $25, while that for a name search is $20.

On the other hand, criminal court records in Canyon County may be accessed at the courthouse or through the Idaho iCourt Portal. These records provide case-by-case information and are not a complete history of a person’s criminal involvement, especially if they have been involved in multiple criminal cases.

Canyon County Probate Records

Canyon County probate records are handled as Magistrate Court cases and are maintained by the Canyon County Clerk. Probate records deal with cases involving wills, estates, guardianships, and conservatorships. They document the process of distributing a deceased person’s assets or appointing a guardian for a minor or incapacitated adult. Typical contents of a probate case file include will and codicils, petitions, estate records, and distribution plans.

Probate records are public in Canyon County and throughout Idaho, but requesters may encounter access limitations for certain documents that may contain confidential information.

Access methods for probate records are the same as those for other court records in the county. Individuals can find information on a probate record by searching the Idaho iCourt Portal. A search can be done using the name of the person listed on the record. Actual documents are not viewable online; only case summaries are available. To view actual documents in the record, inquirers may use the Online Court Records Request Form, visit the County Clerk’s Office in person, or fill out and mail the Court Records Request PDF form to the office.

Canyon County Family Court Records

Family court records in Canyon County pertain to domestic relations cases handled within the Magistrate Court. Family court records cover a range of cases, including divorce, child custody and visitation, child support, paternity, and adoption.

Canyon County family court records are generally public; however, certain documents, such as adoption records and child protective proceedings, are sealed and inaccessible to the public. Access is usually restricted to the parties involved or their attorneys, and often requires a court order or a valid government ID for in-person pickup.

Individuals may fill out the Clerk’s Online Court Records Request Form or complete and mail the printable version to request a family court record. If the case number is unknown, requesters may search the Idaho iCourt Portal using the name on the record to find it. Requests may also be made in person at the Clerk’s Office.

Federal Court Records in Canyon County

Federal cases originating in Canyon County are handled by the U.S. District and Bankruptcy Courts for the District of Idaho, as they are outside the jurisdiction of county and state courts. Canyon County residents can obtain case records generated by this federal court through the PACER (Public Access to Court Electronic Records) system. New users have to register an account on the PACER Registration Page before proceeding with a search. Searches can be made using a case number or party name and cost a fee.
