Canyon County, Idaho Arrest Records

Canyon County arrest records are official documents created by law enforcement agencies after individuals suspected of committing a crime within the county are apprehended. They are used to document arrests for record-keeping purposes and are included in a subject’s Idaho criminal history record. 

Canyon County arrest records promote transparency in law enforcement by allowing review of arrests and related actions. Generally, the Idaho Public Records Act governs access to these records, while Idaho criminal history records and the arrest information they contain are subject to Idaho Code Section 67-3008.

Are Arrest Records Public Information in Canyon, Idaho?

Under the Idaho Public Records Act, codified in Idaho Code §74-101 to 127, Canyon County arrest records are considered public records. According to the Act, public records include information and documents generated and maintained by public agencies in relation to public business they conduct or administer. Given that arrests are regarded as public business, most Canyon County arrest records are public. However, the Act is not absolute. Certain arrest records are exempt from public access. These include, but are not limited to, sealed or expunged records and juvenile arrest records.

Canyon County Arrest Search

Interested persons can find Canyon County arrest information by conducting a statewide criminal history check through the Idaho State Police (ISP) Bureau of Criminal Identification (BCI). Criminal history information provided by the BCI is public per Idaho Code §67-3008. It comprises arrest and disposition data on a subject that criminal justice agencies across Idaho, including those in Canyon County, have reported to the BCI.

Two types of criminal background checks can be conducted through the BCI: name-based and fingerprint-based. For name-based checks, individuals can utilize the Name-Based Criminal Background Check Form. They can complete the form and submit it along with $20.00 to the BCI. Meanwhile, a fingerprint-based check would require requesters to complete the Fingerprint-Based Criminal Background Check Form, submit it with the search subject’s fingerprint card, and pay a $25 fee to the BCI. Relevant fees may be paid via cash, check, credit card, or debit card. Note that credit and debit card payments are subject to a $1.00 fee in addition to a 2.5% transaction charge. In cases where an individual was arrested in Canyon County by a federal or state law enforcement agency and booked in a state or federal correctional facility. Record seekers may find their arrest information using inmate lookup resources provided by the Idaho Department of Corrections (IDOC) or the Federal Bureau of Prisons (BOP). These include the IDOC’s Resident/Client Search database and the BOP’s Inmate lookup portal. These resources are accessible for free and searchable by name or inmate number.

Canyon County Inmate Locator

The Canyon County Sheriff’s Office provides different online resources individuals can use to look up information about recent arrests in the county and county jail inmates. The Current Arrests portal lists individuals who were recently arrested and booked into the Canyon County Jail. Meanwhile, the county Jail Roster provides information on individuals currently housed at the Canyon County Jail or Canyon County Work Release Center, and it is searchable by name.

Active Warrant Search in Canyon County

An arrest warrant is a court order directing law enforcement agencies to apprehend a specific person. Per Idaho Criminal Rule (ICR) 4, a magistrate has the authority to issue an arrest warrant. Generally, a magistrate can issue an arrest warrant after receiving a complaint and determining there is probable cause to believe that a defendant (the individual to be arrested) has committed an offense. A Canyon County arrest warrant usually contains the following information: 

  • The warrant subject's full name and personal information, such as date of birth
  • The warrant subject’s physical description, including sex, race, age, tattoos, eye color, and hair color.  
  • The warrant subject’s mugshot (if available)
  • Warrant number
  • Issurance date
  • Bond amount
  • Charges

Most arrest warrants issued in Canyon County are reported to the Canyon County Sheriff’s Office Warrants Unit. In turn, the Warrant Unit enters them into the various local and national law enforcement databases. Thus, interested persons can search for active warrants in Canyon County by contacting the Canyon County Sheriff’s Office Warrants Unit. They must provide a subject’s full name and date of birth to facilitate the search. Unfortunately, the warrant unit does not offer online resources that individuals can use to conduct their search. Instead, active warrant searches are strictly conducted by calling the office at 208-454-7273. 

How to Find Arrest Records for Free in Canyon County

The most convenient way to find arrest records for free in Canyon County is to review the Current Arrests portal provided by the county Sheriff’s Office. However, there are some limitations to using the portal. For instance, only recent arrests are available on the portal, and older arrests are usually omitted. Additionally, arrests are provided in a list format, and there are no input fields to search for a record by a specific search criterion on the portal.  

Record seekers may also be able to find Canyon County arrest records for free by visiting local law enforcement agencies, such as the Canyon County Sheriff’s Office or municipal police departments, to inspect records. These agencies may allow free inspection of public arrest records. However, they typically charge a fee for copies of documents they furnish to individuals.

Canyon County Arrest Report

A Canyon County arrest report is an official document prepared by an arresting officer that details the circumstances surrounding an arrest from the officer’s perspective. These may include details about the events leading up to the arrest, as well as what occurred during and after the arrest while the suspect was being transported for booking. Meanwhile, an arrest record contains facts about an arrest, such as the arrestee’s name, charges, arrest date, time, and location. Generally, an arrest report is narrative-based, while an arrest record is fact-based and is included in a subject's criminal history record. 

How to Get an Arrest Record Expunged in Canyon County

In Canyon County, an arrest record may be eligible for expungement under Idaho Code §67-3004(10). According to the code, an arrest record qualifies for expungement if:

  • The arrestee was not charged within one (1) year of being arrested
  • The arrestee was acquitted of all charges resulting from their arrest
  • All charges were dismissed.

Eligible individuals may apply for the expungement of their arrest records through the ISP’s Bureau of Criminal Identification (BCI). They may need to provide the following documents when applying:

  • The criminal citation, criminal complaint, summons, or indictment they received from the arresting agency
  • A certified copy of their court order of acquittal or dismissal

Eligible individuals can apply for an arrest record expungement by completing the BCI’s Expungement Application form. The completed form may be mailed along with other required documents and a self-addressed stamped envelope to:

Fortunately, there are no fees for submitting an expungement application. However, it may take up to 30 days for the BCI to process an application.

How Do You Remove Canyon County Arrest Records From the Internet?

There are several ways individuals can remove their arrest records from third-party websites. These include, but are not limited to, the following: 

Apply for record expungement: Arrest records that have been expunged are required under Idaho laws to be protected from public access. Once an arrest record gets expunged, it will be removed from government websites that publish public records online, such as the Canyon County Sheriff’s Office arrests portal. Individuals may also contact third-party websites and present their expungement order to compel the removal of their record from the website's database.

Submitting an opt-out request: Most third-party websites that publish public records, such as arrest records, online allow individuals to request removal of their records from their database. They typically provide an opt-out request form that an individual can complete and submit to make such a request. However, record removal generally is not instantaneous and may require continued monitoring and communication with relevant websites to ensure the record gets removed and is not re-uploaded.
